An exception is land rented out for seasonal recreation not intended for year-round living (like camping or vacation stays) (<a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=59.20.030\">RCW 59.20.030(13)<\/a>). Manufactured housing communities are also known as \u201cmobile home parks\u201d and \u201cmanufactured\/mobile home communities\u201d.<\/p>\n<\/div><\/div><\/div><\/div><div class=\"panel panel-default wpb_accordion_section group\"><div class=\"panel-heading wpb_accordion_header ui-accordion-header\"><p class=\"panel-title font-weight- text-   icon-size-rg\"><a data-toggle=\"collapse\" data-parent=\"#accordion_218069812\" href=\"#1611519327-2-72\"><span>My landlord wants to raise my space rent. How much is allowed?<\/span><\/a><\/p><\/div><div id=\"1611519327-2-72\" class=\"panel-collapse collapse\"><div class=\"panel-body wpb_accordion_content ui-accordion-content half-internal-gutter single-block-padding\">\n\t\t\t\t\t\t<div class=\"uncode_text_column\" ><p>On May 7, 2025 a rent stabilization law <a href=\"https:\/\/lawfilesext.leg.wa.gov\/biennium\/2025-26\/Pdf\/Bills\/Session%20Laws\/House\/1217.SL.pdf?q=20250822084826\">(HB 1217)<\/a> went into effect in Washington state. If you own your manufactured or mobile home and rent a space for your home in a manufactured housing community you are covered by new rules in the <a href=\"https:\/\/app.leg.wa.gov\/rcw\/default.aspx?cite=59.20\">Manufactured\/Mobile Home Landlord-Tenant Act (MHLTA)<\/a>. These new rules apply to all properties covered by the <a href=\"https:\/\/app.leg.wa.gov\/rcw\/default.aspx?cite=59.20\">MHLTA (RCW 59.20)<\/a><strong>. <\/strong><\/p>\n<p><strong>Because of this new law, <\/strong>landlords must follow these rules about raising rent:<\/p>\n<ul>\n<li><strong>No Rent Hikes in the First Year<\/strong> \u2013 Rent can\u2019t be raised during the first 12 months of a tenant\u2019s lease.<\/li>\n<li><strong>5% Limit<\/strong> \u2013 After that first year, rent can only go up by a maximum of 5% in any 12-month period.<\/li>\n<li><strong>Written Notice Required<\/strong> \u2013 Landlords must give tenants written notice of any rent increase using the \u201cRent and Fee Increase Notice to Tenants\u201d form.<\/li>\n<li><strong>This Rule Is Ongoing<\/strong> \u2013 These rent increase limits do not have an end date; they stay in effect until the law is changed.<\/li>\n<li><strong>Some Exceptions Apply<\/strong> \u2013 There are limited reasons when this rule doesn\u2019t apply. The flyer is available in multiple languages on the Attorney General\u2019s <a href=\"https:\/\/www.atg.wa.gov\/landlord-tenant\">\u201cLandlord-Tenant\u201d webpage<\/a>.<\/p>\n<\/div><\/div><\/div><\/div><div class=\"panel panel-default wpb_accordion_section group\"><div class=\"panel-heading wpb_accordion_header ui-accordion-header\"><p class=\"panel-title font-weight- text-   icon-size-rg\"><a data-toggle=\"collapse\" data-parent=\"#accordion_218069812\" href=\"#1611519685483-2-7\"><span>My community might close. What do I do?<\/span><\/a><\/p><\/div><div id=\"1611519685483-2-7\" class=\"panel-collapse collapse\"><div class=\"panel-body wpb_accordion_content ui-accordion-content half-internal-gutter single-block-padding\">\n\t\t\t\t\t\t<div class=\"uncode_text_column\" ><p>Washington state law requires community owners (landlords) to provide a two-year notice of closure, with a few exceptions (<a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=59.20.080\">RCW 59.20.080(1)(e)<\/a>). Community owners must notify tenants and the Department of Commerce (Commerce) (<a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=59.21.030\">RCW 59.21.030<\/a>). Commerce must then mail every tenant an application and information about relocation assistance.<\/p>\n<p>If you own your manufactured or mobile home and live in closing community, you may be eligible for relocation assistance and relocation coordination services administered by Commerce. Financial assistance and services are provided to eligible, income qualifying households on a first-come, first-served basis, prioritizing tenants in communities closed due to park owner fraud or health and safety concerns.<\/p>\n<p>To be eligible for relocation assistance, homeowners must:<\/p>\n<ul>\n<li>Have received a notice of closure<\/li>\n<li>Lived in the home at the time the notice of closure was received<\/li>\n<li>Have a household income that is less than 80% of <a href=\"https:\/\/www.huduser.gov\/portal\/datasets\/il.html\">HUD\u2019s Area Median Income<\/a><\/li>\n<li>Own their manufactured\/mobile home when the closure notice is received.<\/li>\n<\/ul>\n<p>Owners of recreational vehicles (RVs), travel trailers, and park models (as defined in\u00a0<a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=59.20.030\">RCW 59.20.030<\/a>) are not eligible for relocation assistance.<\/p>\n<p>Qualifying homeowners are entitled up to:<\/p>\n<ul>\n<li>$11,000 for a single-section home<\/li>\n<li>$17,000 for a multi-section home<\/li>\n<\/ul>\n<p>Cash assistance is provided in two payments:<\/p>\n<ol>\n<li>When a household is determined eligible; and<\/li>\n<li>When a household either signs over the home\u2019s title to the community owner, upon removal of their home from the community, or the household sells or gifts their home to a third party.<\/li>\n<\/ol>\n<p>For more information, please visit the <a href=\"https:\/\/www.commerce.wa.gov\/homeownership\/relocation-assistance\/homeowner-resources\/\">Manufactured\/Mobile Home Relocation Assistance Program webpage<\/a>, call 800-964-0852, or email <a href=\"mailto:omh@commerce.wa.gov\">omh@commerce.wa.gov<\/a>.<\/p>\n<\/div><\/div><\/div><\/div><div class=\"panel panel-default wpb_accordion_section group\"><div class=\"panel-heading wpb_accordion_header ui-accordion-header\"><p class=\"panel-title font-weight- text-   icon-size-rg\"><a data-toggle=\"collapse\" data-parent=\"#accordion_218069812\" href=\"#1680555071678-4-9\"><span>My community might be sold. What does this mean?<\/span><\/a><\/p><\/div><div id=\"1680555071678-4-9\" class=\"panel-collapse collapse\"><div class=\"panel-body wpb_accordion_content ui-accordion-content half-internal-gutter single-block-padding\">\n\t\t\t\t\t\t<div class=\"uncode_text_column\" ><p>Washington state law requires community owners to give a written Notice of Opportunity to Compete to Purchase to tenants, state, and local government entities (including Commerce) before they market their communities for sale and when they receive an offer to purchase they intend to consider (<a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=59.20.325\">RCW 59.20.325<\/a>).<\/p>\n<p>The Department of Commerce shares these Notices with groups interested in purchasing and preserving manufactured housing communities as affordable housing. These groups are called \u201cEligible Organizations\u201d (<a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=59.20.030\">RCW 59.20.030(4)<\/a>) and include community land trusts, resident nonprofit cooperatives, local governments, local housing authorities, nonprofit community or neighborhood-based organizations, federally recognized Indian tribes in the state of Washington, and regional or statewide nonprofit housing assistance organizations whose goal is to preserve communities as long-term affordable housing.<\/p>\n<p>Tenants and eligible organizations have 70 days after Notice delivery to notify the community owner of their interest in purchasing the community.<\/p>\n<p>A Notice of Opportunity to Compete to Purchase does <strong><u>not<\/u><\/strong> mean tenants or eligible organizations have first right of refusal or any priority to purchase. There is no guarantee, only an opportunity to make an offer to the seller (community owner).<\/p>\n<p>If you receive a Notice of Opportunity to Compete to Purchase, it does not mean your community is going to close. The majority of communities are purchased with the intent to continue operating as a manufactured housing community under new ownership and management.<\/p>\n<\/div><\/div><\/div><\/div><div class=\"panel panel-default wpb_accordion_section group\"><div class=\"panel-heading wpb_accordion_header ui-accordion-header\"><p class=\"panel-title font-weight- text-   icon-size-rg\"><a data-toggle=\"collapse\" data-parent=\"#accordion_218069812\" href=\"#1611519727265-3-2\"><span>My community might be purchased and preserved as long-term affordable housing. What does this mean for me? What are the benefits?<\/span><\/a><\/p><\/div><div id=\"1611519727265-3-2\" class=\"panel-collapse collapse\"><div class=\"panel-body wpb_accordion_content ui-accordion-content half-internal-gutter single-block-padding\">\n\t\t\t\t\t\t<div class=\"uncode_text_column\" ><p>In Washington, manufactured housing communities may be purchased by for-profit entities as well as \u201cEligible Organizations\u201d (<a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=59.20.030\">RCW 59.20.030(4)<\/a>) whose goal is to preserve communities as long-term affordable housing (community land trusts, resident nonprofit cooperatives, local governments, local housing authorities, nonprofit community or neighborhood-based organizations, federally recognized Indian tribes in the state of Washington, and regional or statewide nonprofit housing assistance organizations).<\/p>\n<p>Each eligible organization has its own process when purchasing a manufactured housing community guided by specific rules and regulations.<\/p>\n<p>The most common preservation model in Washington is a \u201cresident-owned cooperative\u201d. <a href=\"https:\/\/nwcdc.coop\">Northwest Cooperative Development Center<\/a> i <a href=\"https:\/\/nwcdc.coop\/roc-northwest\/\">ROC Northwest<\/a> help tenants form a cooperative business, secure financing, and purchase the community in which they live.<\/p>\n<p>ROC Northwest created the following materials to provide more information about resident-owned communities:<\/p>\n<ul>\n<li><a href=\"https:\/\/deptofcommerce.app.box.com\/s\/fsn6727kc79svsi6aemjn89g31n31blx\/file\/1259784972035\">Resident Ownership Basics: How a Cooperative Works<\/a><\/li>\n<li><a href=\"https:\/\/deptofcommerce.box.com\/s\/fsn6727kc79svsi6aemjn89g31n31blx\">Information About Resident Owned Communities<\/a><\/li>\n<\/ul>\n<p>Benefits of living in communities preserved as long-term affordable housing include:<\/p>\n<ul>\n<li><strong>Stability:<\/strong> the land cannot be redeveloped or sold for another purpose, limiting the risk of displacement<\/li>\n<li><strong>Affordability:<\/strong> homeowners may pay less in space rent and fees overtime (rent may increase at time of purchase)<\/li>\n<li><strong>Preservation of community:<\/strong> physical and social preservation (maintaining the social connections of neighbors)<\/li>\n<\/ul>\n<p><em><a href=\"https:\/\/nwcdc.coop\/roc-northwest-available-units-in-wa-resident-owned-parks\/\">View list of homes for sale and vacant lots for home placement in Washington Resident-Owned Communities (ROCs)<\/a><\/em><\/p>\n<\/div><\/div><\/div><\/div><div class=\"panel panel-default wpb_accordion_section group\"><div class=\"panel-heading wpb_accordion_header ui-accordion-header\"><p class=\"panel-title font-weight- text-   icon-size-rg\"><a data-toggle=\"collapse\" data-parent=\"#accordion_218069812\" href=\"#1763719979764-5-2\"><span>My manufactured\/mobile home needs repair. What services are available?<\/span><\/a><\/p><\/div><div id=\"1763719979764-5-2\" class=\"panel-collapse collapse\"><div class=\"panel-body wpb_accordion_content ui-accordion-content half-internal-gutter single-block-padding\">\n\t\t\t\t\t\t<div class=\"uncode_text_column\" ><p>The Department of Commerce (Commerce) administers the <a href=\"https:\/\/www.commerce.wa.gov\/weatherization\/hrgp\/\">Home Rehabilitation Grant Program (HRGP)<\/a>. HRGP funding helps homeowners with home-repair improvements that address health, safety, and durability issues in homes in rural areas. Households with seniors, disabled members, veterans, and children under five years old have priority. Rehabilitation agencies are located throughout the state.
